Terms and Conditions

These terms and conditions bring together, in a single document, the terms of sale, delivery, returns, warranty, data protection and accessibility of the vultus.ch website. They replace all previously published versions and separate policies.

1. Purpose and scope

These terms and conditions (the "Terms") govern all sales of products made on the vultus.ch website, operated by FJ Design Sàrl, Rue de la Bergère 3C, 1217 Meyrin, Switzerland, UID CHE-114.027.201 ("FJ Design", "we" or "us").

Placing an order implies full acceptance of these Terms. The customer declares that they have the legal capacity to enter into a contract.

In the event of any conflict between these Terms and any other information on the website, these Terms prevail.

2. Products

Products are described and presented as accurately as possible. Photographs and descriptions are provided for illustrative purposes only and are not contractually binding. Slight variations, in particular in colour, shade, finish or appearance, may exist from one unit to another or compared with the photos, without affecting the essential characteristics of the product; they do not constitute a defect.

Results and performance may vary depending on the user, conditions of use and environment.

Magnification. Magnification values are determined according to our own definition and measurement method. There is no single definition applied across the market for this type of product; values stated by other manufacturers may be based on other methods and are not directly comparable with ours.

The magnifications stated are therefore indicative and do not constitute a guaranteed value. No claim may be based on a difference between the stated value and a value measured using another definition or method.

In addition, our products are manufactured within mechanical and optical tolerances. Magnification, dimensions and other characteristics may therefore vary slightly from one unit to another, without this constituting a defect.

Customers who need a precise value, according to a definition or method they specify, may submit a special order request. The terms, lead time and price are then subject to prior written agreement, and only the value so agreed is contractually binding.

3. Orders

An order is confirmed once payment has been received. An order confirmation is sent to the customer by email.

Products are sold subject to available stock. If a product turns out to be unavailable after the order, we will inform the customer and offer a new delivery date. The customer may accept this date or cancel the order and receive a full refund, including shipping costs.

FJ Design reserves the right to refuse or cancel an order in the event of suspected fraud, an obvious pricing error or permanent unavailability of the product. The customer will be informed and refunded in full.

4. Prices and payment

Prices are shown in Swiss francs (CHF), excluding shipping costs.

If you have any doubt about the final price or the costs applicable to your order, please contact us at contact@vultus.ch before ordering.

Shipping costs are calculated automatically when the order is placed. For deliveries outside Switzerland, customs duties and/or local VAT may be added (see section 5.3).

Payment is due immediately upon ordering. Transactions are secured by our certified payment providers; FJ Design does not have access to your full card details.

5. Delivery

5.1 Shipping

Products are shipped from our stock to the address given when ordering. Shipping normally takes about 1 week from order confirmation, subject to availability (see section 3).

5.2 Delivery areas and times

We deliver within Switzerland and internationally. Delivery times vary by destination country and carrier; they are communicated at the time of shipping and are indicative only.

5.3 Shipping costs, customs and VAT

Basic shipping costs are calculated automatically when the order is placed. Additional shipping costs may be requested, in particular for certain international destinations; the customer is informed before shipping and may then cancel the order with a full refund.

For deliveries outside Switzerland, customs duties and/or local VAT may apply if they are not included in the amount paid. These costs depend on the regulations of the destination country and are borne by the customer.

5.4 Delays

We are not liable for delays attributable to carriers or to exceptional circumstances (force majeure, customs, strikes, logistics disruptions, etc.).

A significant delay means:

  • an order not shipped within 30 days of confirmation or, if a new date has been communicated to and accepted by the customer, by that date;

  • a parcel not delivered within 30 days of shipping.

In the event of a significant delay or if delivery is impossible, the customer may cancel the order and receive a full refund, free of charge.

If the product has already been shipped or received, it must be returned to us in good condition, unused and in its original packaging. Return costs are borne by us: we provide a prepaid return label or reimburse the costs upon presentation of proof. The refund is made after receipt and inspection of the product.

6. Returns and refunds

6.1 Right of return

Irrespective of any statutory right of withdrawal applicable in the customer's country of residence, FJ Design offers a return period of 30 days from receipt, provided that the product is new, unused, intact and in its original packaging.

To initiate a return, the customer must first contact us at contact@vultus.ch, quoting the order number. We will provide the return address and instructions.

6.2 Costs

Return costs are borne by the customer, except in the case of a defective product or an error on our part. Initial shipping costs are only refunded in the case of a defective product or an error on our part.

6.3 Refund

After receipt and inspection of the returned product, we refund the price of the product within a maximum of 14 days, using the payment method used for the order.

A returned product that is incomplete, used or damaged may be subject to a partial refund or refusal; the customer is informed before any decision is made.

7. Warranty

Products are covered by a contractual warranty of 1 year from delivery, covering manufacturing defects arising under normal use. This warranty is in addition to, and does not replace, any mandatory statutory warranties applicable in the customer's country.

In the event of a confirmed defect, FJ Design will, at its discretion, repair, replace or refund the product, at no cost to the customer (including return costs).

The warranty does not cover:

  • normal wear and tear;

  • damage resulting from incorrect use or use not in accordance with the instructions;

  • impacts, drops or breakage, whether accidental or intentional;

  • modifications or repairs carried out by an unauthorised third party;

  • loss or theft.

For any warranty claim, the customer should contact contact@vultus.ch with the order number, a description of the defect and, if possible, photos.

8. Use and liability

Products must be used in accordance with their intended purpose, the precautions below and, where applicable, the user guide available on the website.

8.1 Safety precautions

Our products are worn in contact with the skin and used close to the eyes. The user agrees to observe the following precautions:

  • Skin contact: the materials in contact with the skin are chosen for this purpose. However, individual sensitivity can never be ruled out. In the event of redness, irritation or an allergic reaction, stop using the product immediately and consult a healthcare professional if necessary. If you have a known allergy or any question about the materials used, please contact us before purchasing.

  • Use near the eyes: never look directly at the sun or an intense light source through the product. Before each use, visually check the condition of the product, in particular the optical part. Do not use a damaged product (cracked or scratched optics, loose parts, sharp edges).

  • Eye strain: prolonged use may cause eye fatigue, headaches or dizziness. Take regular breaks and stop using the product if you feel any discomfort.

  • Hazardous activities: do not use the product while driving, moving around in traffic or during any activity where altered visual perception could be dangerous.

  • Health: our products are not medical devices. If you have a vision problem or any doubt, seek the advice of an ophthalmologist or optician before use.

  • Children: keep out of the reach of children; any use by a minor must be supervised by an adult.

8.2 Limitation of liability

Except in cases of wilful misconduct or gross negligence, FJ Design is not liable for:

  • misuse of the product;

  • indirect damage;

  • loss of business or loss of data.

Wherever it can validly be limited, FJ Design's liability is capped at the amount of the order concerned.

9. Data protection

We process your personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, for customers in the European Union, the GDPR. Your data is never sold.

9.1 Data controller

9.2 Data collected and purposes

We only collect the data necessary when you place an order or contact us (form or email):

  • first and last name, postal address, email address, phone number;

  • information about your orders and your exchanges with us;

  • payment information, processed directly by our payment providers.

This data is used solely to process and ship your orders, provide customer service (returns, warranty), contact you about your order and comply with our legal obligations (accounting, tax).

9.3 Sharing and transfers abroad

Your data is only shared with providers essential to running the shop: the website host, Infomaniak Network SA, in Switzerland; our online shop platform (Wix.com), which also handles payment processing with its payment partners; and our carriers. These providers may process data outside Switzerland, in particular in the EU, Israel or the United States; in that case, the transfer relies on appropriate safeguards (a country recognised as providing adequate protection, or standard contractual clauses).

9.4 Cookies

The website, provided by Wix.com, uses cookies necessary for its operation (navigation, cart, payment, security) and, with your consent where required, analytics cookies. You can manage your preferences via the cookie banner or your browser settings.

9.5 Security and retention

Data is stored on our providers' servers and protected by appropriate technical and organisational measures. It is kept for as long as necessary to process orders, then for the period required by law (in Switzerland, 10 years for accounting records).

9.6 Your rights

You may at any time request access to, correction or deletion of your data, or object to its processing, by writing to contact@vultus.ch. You may also contact the Federal Data Protection and Information Commissioner (FDPIC) or, in the EU, the authority in your country.

10. Accessibility

We strive to make our website accessible to as many people as possible, including people with disabilities, and continuously improve its accessibility and usability. If you have difficulty accessing any content or feature, contact us at contact@vultus.ch and we will offer a suitable solution, including for placing an order.

11. Governing law and jurisdiction

These Terms are governed by Swiss law, subject to the mandatory consumer protection provisions of the customer's country of residence.

Any dispute falls under the jurisdiction of the courts of the Canton of Geneva, subject to the mandatory jurisdiction rules applicable to consumers. Before taking any legal action, we invite the customer to contact us to seek an amicable solution.

12. Changes and contact

We may amend these Terms at any time. The terms applicable are those in force on the date of the order. The date of the last update appears at the top of this document.
